We are Federal Immigration Litigation Attorneys

Habeas Corpus

We represent detained noncitizens in habeas corpus proceedings seeking prompt judicial review of unlawful or prolonged immigration detention. Where detention continues without a meaningful bond hearing, rests on legal error, or exceeds what due process permits, we prepare and file petitions in U.S. District Court requesting release, a constitutionally adequate bond hearing, or other appropriate relief. Each case is developed through careful review of the custody record, criminal and immigration history, and detention authority invoked, with focused briefing and expedited motion practice where liberty interests and urgent circumstances require immediate action.

Immigration Court

We represent clients in Immigration Court in connection with EOIR-42 and Asylum applications for cancellation of removal, preparing complete, well-supported filings and presenting the cases through the individual hearing. Our work includes a careful eligibility analysis, strategic case planning, and the assembly of documentary proof addressing continuous physical presence, good moral character, and statutory inadmissibility or deportability issues that may affect relief. We prepare detailed client and witness declarations, obtain corroborating records (tax filings, medical and school records, employment history, country conditions, and community support letters), and develop a persuasive hardship presentation tailored to qualifying relatives, including children, spouses, or parents. We also manage all court deadlines and procedural requirements, conduct thorough hearing preparation, and present direct and cross-examination with a record-focused approach that supports discretionary relief and preserves issues for appeal when appropriate.

Federal Appeals

We represent clients in federal immigration appeals before the U.S. Courts of Appeals, seeking review of final orders of removal and related agency decisions. Our practice includes evaluating appealable issues, filing petitions for review within the applicable statutory deadlines, and pursuing stays of removal where immediate relief is necessary. We prepare record-focused briefs that address legal and constitutional errors, adverse credibility determinations, due process violations, and misapplications of the governing standards for asylum, withholding of removal, and CAT protection. Throughout the process, we manage the administrative record, comply with strict appellate rules, and develop a clear litigation strategy aimed at securing remand, termination, or other appropriate relief.
